GAFILAT Latin America AML Brief

January 1, 2026·Financial Action Task Force of Latin America (GAFILAT)·US

GAFILAT convenes 18-member states to advance FATF Recommendation 8 implementation for nonprofit sectors

GAFILAT held a special session on July 15 and 16, 2026 in Lima, Peru, during its 53rd Plenary of Representatives, co-organized with the EU AML/CFT Global Facility and Germany's GIZ. The session addressed FATF amendments to Recommendation 8 on nonprofits, covering risk-based monitoring, sectoral risk assessments, and unintended consequences of disproportionate AML/CFT measures.

The session places all 18 GAFILAT member states on notice that revised FATF Recommendation 8 compliance requires affirmative action: sectoral risk assessments for the nonprofit sector, risk-based supervisory mechanisms, and documented evidence that implementation avoids disproportionate harm to legitimate organizations. Regulatory bodies and financial intelligence units across Latin America that have not yet updated their nonprofit oversight frameworks carry direct mutual evaluation exposure. The proportionality constraint is now a scored element of the FATF assessment methodology, not a discretionary design choice.

  • Amended FATF Standards Now Under Active Regional Implementation: All 18 GAFILAT member states participated in technical workshops examining the revised Recommendation 8 text, its Interpretive Note, the updated Assessment Methodology, and the FATF Best Practices document. National authorities responsible for nonprofit sector oversight now face direct pressure to align domestic frameworks with these revised standards.
  • Sectoral Risk Assessments Identified as a Core Compliance Gap: Discussions centered on how member states should develop nonprofit-specific sectoral risk assessments. Countries that have not yet conducted such assessments face exposure in upcoming FATF-style body mutual evaluations, where Recommendation 8 compliance is a scored criterion.
  • Risk-Based Monitoring Mechanisms Required: The session emphasized that monitoring of nonprofit organizations must be proportionate and risk-focused, not blanket. Regulatory bodies overseeing nonprofit sectors across GAFILAT jurisdictions are expected to review existing supervisory frameworks for alignment with this proportionality standard.
  • Unintended Consequences Formally Acknowledged as a Compliance Design Constraint: Participants addressed the documented risk that overly broad AML/CFT measures applied to nonprofits can impede legitimate charitable activity. FATF's revised Recommendation 8 explicitly incorporates this constraint, and member states must now demonstrate that their implementation avoids de-risking or operational harm to compliant organizations.

- FATF revised Recommendation 8 in 2023, shifting from a presumption that nonprofits are terrorism-financing risks to a risk-based, proportionate approach. This session is GAFILAT's first structured regional implementation workshop under the revised standard.

- The session's explicit focus on unintended consequences marks a structural departure from earlier FATF guidance, which did not formally require member states to assess regulatory harm to legitimate nonprofit operations.

- Co-sponsorship by the EU AML/CFT Global Facility aligns with the European Commission's parallel push to embed proportionality requirements in its own AML framework under the EU AML Package adopted in 2024.

HIGH — This action carries confirmed regulatory impact beyond its home jurisdiction.
