DMCA Policy & Designated Agent

1. Overview
Cresthaven Analytics LLC ("Cresthaven," "we," "our," or "us") respects the intellectual property rights of others and expects users of our services to do the same. This policy describes our procedures for responding to notices of claimed copyright infringement under the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512.
2. Designated Copyright Agent
In accordance with the DMCA, we have designated an agent to receive notifications of claimed copyright infringement. If you believe that any content on our website or in our services infringes your copyright, please submit a written notice to our designated agent at the following address:

3. Notice of Claimed Infringement
To file a valid DMCA takedown notice under 17 U.S.C. § 512(c)(3), your written notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit us to locate the material (for example, the URL of the infringing page).
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Incomplete notices may not be actionable. Knowingly misrepresenting that material is infringing may subject you to liability for damages under 17 U.S.C. § 512(f).
4. Counter-Notification Procedure
If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g)(3) to our designated agent. Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed or to which access was disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of that person.
Upon receipt of a valid counter-notification, we may restore the removed material unless the original complainant files a court action within the statutory window.
5. Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), we will, in appropriate circumstances, terminate the accounts of subscribers and users who are determined to be repeat infringers.
6. Relationship to Other Policies
This DMCA Policy supplements our Terms of Service and Acceptable Use Policy. Intellectual property rights in Cresthaven content are described in Section 6 of the Terms of Service. Prohibited redistribution and competitive use of our intelligence products are described in the Acceptable Use Policy.
